Terms of Use

Version 1.0 · Effective 18 August 2026

These Terms of Use ("Terms") are a legal agreement between you and Yarnmaker Pty Ltd (ABN 11 112 559 029, ACN 112 559 029), trading as Tripcruncher ("Tripcruncher", "we", "us" or "our"), of PO Box 5340, Stafford Heights, Queensland 4053, Australia. They apply to the Tripcruncher website, application, AI-assisted search, trip-planning tools and related services (together, the "Service").

1. Accepting these Terms

You agree to these Terms when you affirmatively accept them through the Service. Creating an account, viewing a page, continuing to browse, or making a cookie choice does not by itself record acceptance of these Terms. When accepting, you will also be given access to our Privacy Policy, which explains how we handle personal information. If you do not agree to these Terms, do not accept them or use the account features of the Service. If you use the Service for an organisation, you confirm that you have authority to bind that organisation, and "you" includes it.

2. Eligibility and international use

You must be at least 18 years old to purchase Search Tokens. If you are under 18, you may use the Service only with the permission and supervision of a parent or legal guardian who has reviewed and accepted these Terms for you.

The Service is operated from Australia and may not be available or appropriate in every country. If you use it elsewhere, you are responsible for complying with laws that apply to you. You must not use the Service where doing so would breach applicable trade sanctions, export controls or other laws. Nothing in these Terms removes a consumer or other legal right that the law of your country, state or territory does not allow you to waive.

3. What Tripcruncher does

Tripcruncher is a trip-planning and visualisation tool. It is not a travel agent, booking service, tour operator, insurer, transport provider, accommodation provider, emergency service or professional adviser. Unless we clearly say otherwise, we do not sell or make bookings and are not a party to any arrangement you make with a venue, carrier, accommodation provider or other third party.

4. Your account and security

You must provide accurate account information, keep your sign-in credentials secure and promptly tell us about suspected unauthorised access. You are responsible for activity through your account except to the extent it results from our failure to take reasonable care or another matter for which the law makes us responsible. You must not share, sell or transfer your account or allow another person to use it to avoid charges, limits or restrictions.

The Service uses necessary cookies and similar technologies for sign-in, security, session continuity and saved settings. Optional usage analytics are controlled separately through Cookie Settings and are not a condition of accepting these Terms or using the core Service. Rejecting or later withdrawing optional analytics permission is not a breach of these Terms. See the Privacy Policy for the current categories, providers and controls.

5. Your content, traveller information and sharing

You retain ownership of the trip details, notes, images, links and other content you submit ("Your Content"). You give us a non-exclusive, worldwide, royalty-free licence to host, copy, process, transmit and display Your Content only as reasonably needed to operate, secure and improve the Service, provide features you request and comply with law. This licence ends when Your Content is deleted, subject to reasonable backup cycles and legal retention requirements.

You must have the right to submit Your Content. If it includes information about another traveller, you must have their permission or another lawful basis to provide it. Do not store passport numbers, payment-card details, medical records or other highly sensitive information unless a feature expressly asks for it and explains how it will be handled.

You control who you invite and which sharing setting you select. People you invite may be able to view, copy or change trip information according to their permissions. Anyone with a public or shareable link may be able to forward it. Review a trip before sharing it and remove confidential or unnecessary personal information.

6. AI output and information from other sources

The Service may use generative artificial intelligence and information from third-party sources such as mapping, places, venue, transport or travel-information providers. Providers and sources may change without notice. AI output is probabilistic and may invent, misinterpret or omit information. Any information in the Service may be inaccurate, incomplete, duplicated, unavailable or out of date, whether it comes from AI, a third party, another user or us. A source link, confidence label, map result or "grounded" result does not guarantee accuracy or currency and is not our endorsement.

You are responsible for independently checking information before relying or acting on it. Confirm important details directly with the relevant provider and, where appropriate, current official sources. This includes identity and location, dates and times, availability, prices and fees, opening hours, bookings, cancellation terms, routes, travel time, accessibility, age or height limits, entry and visa requirements, health advice, allergens, safety conditions, laws, weather and government travel advice. Recheck time-sensitive details close to travel. Do not rely on the Service as the only copy of a booking, ticket, visa, itinerary, emergency detail or other important record.

Suggestions are general planning information, not legal, medical, financial, immigration, safety or other professional advice. Use qualified professionals and official authorities when those matters are important. In an emergency, contact the appropriate local emergency service.

7. Third-party services and bookings

The Service may display or link to third-party websites, maps, content and services. Your dealings with a third party are governed by that party's prices, availability, terms and privacy practices. We do not control third-party services and are not responsible for their acts, omissions, content, outages or changes. Check the final details and terms before making or changing any booking or payment.

8. Search Tokens and payments

If we offer prepaid usage credits called "Search Tokens", each Search Token is a limited right to submit an eligible search or request described at purchase or use. Search Tokens are not money, legal tender, a bank deposit, an investment or a stored-value payment account. They do not earn interest, cannot be redeemed for cash and cannot be transferred, traded or resold unless we expressly allow it.

Before purchase, we will show the pack price, number of Search Tokens, currency, applicable taxes and material conditions, including any expiry date. Launch prices are displayed and settled in US dollars. If no expiry is disclosed when paid Search Tokens are purchased, those Search Tokens do not expire. Promotional or complimentary tokens may have separate conditions disclosed when issued.

The Service will show the number of Search Tokens required before an eligible request is submitted. A token may be used when we accept the request for processing because third-party and computing costs may then be incurred. Search quality, usefulness, quantity and novelty are not guaranteed. If a technical failure produces no result, we will not deduct the token or will recredit it, unless we reasonably determine that the request breached these Terms or was part of fraudulent or abusive activity.

Prices and token requirements may change for later purchases or requests, but we will not retrospectively change the purchase price or quantity of tokens already bought. Except where these Terms say otherwise, payments are final and we do not provide change-of-mind refunds. This does not limit any refund, recredit or other remedy required by applicable consumer law.

Payments may be processed by a third-party payment provider under its own terms. You authorise the displayed one-off charge and must not use a payment method without permission. We may correct a token balance that resulted from an error, duplicate credit, reversed or disputed payment, refund or fraud, but will provide reasonable notice and an explanation where practicable. We may suspend purchases or token use while we investigate suspected fraud, chargebacks or account compromise.

9. Acceptable use

You must not use or attempt to use the Service to:

  • break any law, infringe another person's rights, deceive, harass, threaten or cause harm;
  • upload malware or harmful code, probe security, gain unauthorised access or disrupt the Service;
  • bypass access controls, rate limits, token charges, usage limits or account restrictions;
  • scrape, crawl, bulk extract or automatically access the Service without our written permission;
  • reverse engineer or copy protected parts of the Service except to the extent the law permits;
  • extract system prompts, credentials, private data or confidential information;
  • impersonate another person, misuse invitations or sharing links, or submit content you cannot lawfully use; or
  • resell the Service, Search Tokens or outputs, or use them to build a competing dataset or service, unless we have agreed in writing.

10. Suspension and termination

We may limit, suspend or terminate access if we reasonably believe you have seriously or repeatedly breached these Terms, created a security or legal risk, failed to pay an amount due, engaged in fraud or abuse, or used the Service in a way that could harm us, our providers or other users. Where appropriate, we will consider the seriousness of the conduct and give notice and a reasonable opportunity to respond or fix the issue. We may act immediately where reasonably necessary to prevent harm, comply with law or protect the Service.

A suspension prevents use of Search Tokens while it continues. If we terminate for a serious breach, we may cancel unused promotional tokens. We will cancel unused paid tokens only to the extent reasonably necessary because of the breach and permitted by law. If we discontinue the paid Service for reasons unrelated to your breach, we will provide a reasonable way to use affected paid tokens or an appropriate refund or other remedy. You may stop using the Service at any time. Terms that by their nature should continue after termination remain in effect.

11. Service changes, availability and your records

We may maintain, change or discontinue features to improve the Service, respond to security or legal requirements, or reflect changes in our providers. We do not promise uninterrupted or error-free access. We will give reasonable notice of a material reduction to a paid feature where practicable and respect remedies required by applicable law.

Keep independent copies of booking confirmations, tickets, travel documents and other information you cannot afford to lose. Tripcruncher is a planning aid and is not the authoritative source for a booking, border requirement, safety instruction or emergency detail.

12. Our intellectual property

We and our licensors own the Service, including its software, design, branding and content other than Your Content and third-party content. We give you a limited, personal, non-exclusive, non-transferable and revocable right to use the Service in accordance with these Terms. No other rights are granted. Feedback you voluntarily provide may be used without restriction or payment, but we will not identify you as its source without permission.

13. Mandatory consumer rights and liability

Nothing in these Terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded under the laws that apply to you. Australian consumers have guarantees under the Australian Consumer Law that cannot be excluded and may be entitled to a remedy if we fail to meet them. Consumers elsewhere may have equivalent or additional mandatory rights under their local laws.

Subject to those non-excludable rights, you use the Service at your own risk. To the maximum extent permitted by law, we are not liable for loss to the extent it is caused by your failure to independently verify information, your breach or misuse, inaccurate information supplied by you or another user, or the acts, omissions, terms or failure of a third-party provider. We are also not liable for indirect or consequential loss that was not reasonably foreseeable when you accepted these Terms.

To the maximum extent permitted by law, our total liability arising from the Service is limited to the greater of US$100 and the amount you paid us for the Service in the 12 months before the event giving rise to the claim. This limit does not apply to fraud or wilful misconduct, death or personal injury caused by our negligence, or any liability that cannot lawfully be limited.

14. Changes to these Terms

We may update these Terms. Each published version shows a version number and effective date. If a change is material, we will provide reasonable notice where practicable and may require you to expressly accept the new version before continuing to use the Service. If you do not accept it, you may lose access to some or all of the Service, but we will still provide any access or remedy required by law. Changes will not retrospectively alter completed purchases or accrued rights unless required by law or expressly agreed with you.

15. General

If part of these Terms is invalid or unenforceable, it is to be read down to the minimum extent necessary and the remaining parts continue. A delay in enforcing a right is not a waiver. You may not assign these Terms without our written consent. We may assign them as part of a genuine business transfer if this does not reduce your rights. These Terms and any additional terms clearly presented for a particular feature or purchase form the agreement about the Service. The Privacy Policy is a notice describing how we handle personal information; acknowledging or receiving it is not agreement to optional analytics or other processing that requires a separate choice.

16. Governing law and disputes

These Terms are governed by the laws of Queensland, Australia. The courts and tribunals with jurisdiction in Queensland may hear disputes. If the law where you live gives you the right to bring a claim or use a consumer process elsewhere, this clause does not take that right away. Before starting formal proceedings, please contact us and give us a reasonable opportunity to resolve the issue. This does not limit your right to contact a regulator, seek urgent relief or use any process available under applicable law.

17. Contact

Questions, complaints, token-balance issues and legal notices can be submitted through our Help Centre or sent to Yarnmaker Pty Ltd (ABN 11 112 559 029, ACN 112 559 029), PO Box 5340, Stafford Heights, Queensland 4053, Australia.
